COVINGTON, La. (WGNO) – You may remember that controversial “Other Bad Acts” filing with Dave Peralta’s sexual battery case in Saint Bernard Parish. Well, the state has filed another document, this time related to the stalking charge here in Saint Tammany Parish. And guess what it’s called? “Other Bad Acts”.

But this new “Other Bad Acts” filing is under seal and will stay under seal for now.

Wednesday, Peralta’s lawyers asked a judge to keep that filing under seal. Arguing that this “Other Bad Acts” filing should be ruled on by the court before presented. The state rebuked that the public has a right to know what’s going on with a public official case.

Judge Scott Gardner told Peralta’s lawyers that they had until this Friday to file a memorandum strengthening their argument. He then added, “As a prosecutor, I was always grateful when jurors had not been tainted ahead of time and defendant’s had a fair trial”.

Judge Gardner said he would review the memorandum from Peralta’s lawyers on Friday.

Then the judge asked if anything else needed to be addressed and Assistant Attorney General David Weilbacher said: “Last week there was an uncomfortable situation with the defendant and witnesses.”

He was cut off by Peralta’s lawyer Martin Regan, who asked if they could all approach the bench. After some whispering, the judge said the defendant, Peralta, could not contact intentionally with anyone involved in the case out of normal business conversations — likely related to Saint Bernard Parish business.

There will be another hearing June 3, 2015.

It could be scheduled earlier though, depending on when they get through that memorandum.

This stalking case is set to go to trial on June 22, 2015.

Peralta also faces sexual battery charges involving his wife in Saint Bernard Parish.
