NEW ORLEANS (WGNO) — If you’re thinking about putting your apartment on AirBNB to make a few bucks this carnival season fair warning, it’s against the law.
Under the current law, it is illegal for residents to rent their property for less than 30 days. If you live in the French Quarter, it’s illegal to rent a property for less than 60 days.
A study on short-term rentals out Tuesday estimate there are 2,000 to 4,000 illegal, unlicensed rentals in New Orleans, but the city doesn’t have the resources to stop it.
In 2014, the city sent violation letters to about 34 properties. In 2015, that number rose to 72 properties. An example of a violation letter can be viewed here.
After the second violation, property owners could face a fine of over $500. After the third violation, property owners could see jail time.
City officials say it’s hard to prove that property owners who are renting properties on a short-term basis are violating the law, under current zoning laws.
If residents suspect a property is an illegal short-term rental they may call (504) 658-7100 and report it to the City’s Department of Safety and Permits.
New Orleans City Planning Commission who performed the study at the request of the city council suggested the city should start offering short-term rental licenses. The city council will review the study starting February 1.
